Purposes and methods of data processing

Pursuant to Article 13 of the EU Regulation 2016/679), we inform you that the personal data you provide to the site, will be processed, also with the aid of electronic tools, with logics related to the purposes indicated below:

  1. purposes strictly related to and necessary for registration and authentication to this site;
  2. purposes strictly necessary for the performance of the services offered on the site;
  3. functional purposes of our business such as: creation of your user profile for the improvement and customization of the site and services offered;
  4. purposes necessary to fulfill an obligation required by law, regulation or EU legislation such as, but not limited to, drug supervision, health protection, protection of public order, detection and prosecution of crimes.

With limited reference to the purposes under points 1), 2) and 3), your data may be communicated to our Suppliers designated as Data Processors by the Data Controller. Finally, with regard to the purposes set forth in point 4), your data will only be communicated to those entities that are entitled to receive them based on the legal obligations that exist for the Data Controller.

Data dissemination

The data collected from our site are not subject to dissemination, except Your prior and specific consent that will be requested from You in the time and manner prescribed by law.

Legal basis for processing

The legal basis for the processing of your personal data collected through this site, for the purposes referred to in points 1) and 2), is to be found in Article 6(1)(b) of the GDPR relating to the performance of contractual or pre-contractual measures at the request of the data subject.The processing for the purposes referred to in point 3), will only take place after your express, free, specific and revocable consent, pursuant to Article 6(1)(a) of the Regulations. The legal basis for the processing of your personal data for the purposes referred to in point 4) is the need to comply with a legal obligation, pursuant to Article 6, paragraph 1, letter (c) of the Regulations.

Consent to treatment

The consent formulation will refer to the above-mentioned processing, without prejudice to your ability to withhold consent for any or all of the processing. We inform you, however, that without your consent we will not be able to proceed with the processing of the data concerning you. In any case, even where you have given consent to one or more of the treatments indicated, you will remain free at any time to revoke it by sending a specific request without formality by e-mail to the following address: privacy@offhealth.it . Following receipt of such a request, it will be the responsibility of OFFHEALTH S.p.A. to proceed promptly to remove and delete your personal data from the databases used for the aforementioned purposes and to inform you of any third parties to whom the data has been communicated.

Retention of personal data

Your personal data are recorded in paper and electronic files located at the OFFHEALTH S.p.A. Headquarters and at the peripheral facilities of the Company and in remote electronic files, using the so-called “cloud” technology allocated on servers installed within the European Union. They will be kept for the time necessary for the fulfillment of the purposes indicated above and for a maximum of four years from the last contact with you, unless your previous request for deletion. Tax and fiscal data will be kept for the period of ten years required by law.

Rights under Art. 15 et seq. Regulations.

We remind you that Art. 15 et seq. of the Regulations grant you the following rights: (i) to obtain confirmation as to whether or not your personal data is being processed at OFFHEALTH S.p.A. ; to know its purposes; to know which categories of personal data are subject to it and, where possible, their storage period; who the recipients are; to request the rectification or deletion of the same data, the limitation of the processing or to oppose or revoke your consent; to know its origin if collected from third parties; to know if there is an automated decision-making process on it (e.g. profiling) as well as its logic and consequences; (ii) to be informed in case of transfer of their data to a non-European country and whether there are adequate safeguards. (iii) to obtain a copy of their data in a structured, commonly used and machine-readable format as well as the possibility of transmitting them, either directly or through OFFHEALTH S.p.A. to another data controller (so-called right to data portability ex art. 20 of the Regulation).

To exercise your rights, you may send a request without formality by e-mail to privacy@offhealth.it . If you believe that your rights have been violated by OFFHEALTH S.p.A., you have the right to lodge a complaint with the Garante per la protezione dei dati personali and/or other competent supervisory authority under the Regulation.
